Rental Terms and Conditions

1. General & Acceptance

This Agreement and the associated Invoice/Order constitute the contract between Yellow Event Rentals and the Customer. Acceptance of Goods or payment of a deposit constitutes acceptance of these terms. Any agent or planner signing on behalf of a Customer binds that Customer to these terms.

2. Payment & Quotes

• Deposit: A 50% non-refundable deposit is required to secure your date.
• Final Balance: Due 7 days prior to the event date.
• Additional Fees: Quotes are estimates. Final totals may change due to site access issues, missing items, or damaged goods. Yellow Event Rentals may charge the credit card on file for any post-event balances.

3. Cancellations & Changes

• Cancellations: If canceled more than 14 days before the event, the deposit is forfeited. If canceled within 14 days, the full contract amount is due. All cancellations must be made in writing via email.
• Changes: Items may be added (subject to availability) or swapped at any time. Removing items within 14 days of the event will not result in a refund or credit.

4. Delivery, Access, & Inspection

• Access: Customer must provide safe, clear access for delivery/retrieval. If the site is unsafe or inaccessible, Yellow Event Rentals may refuse delivery without refund.
• Inspection: Customer must inspect all Goods upon pickup or delivery. Any shortages or defects must be reported at the time of delivery/pickup; otherwise, Goods are deemed accepted in good condition.

5. Damage, Loss, & Cleaning

• Responsibility: Customer is liable for Goods from the moment of pickup/delivery until they are returned to or retrieved by Yellow Event Rentals.
• Damage/Loss: Except as covered by the Damage Waiver, items lost, stolen, or damaged will be billed at full replacement value or repair cost.
• Condition: Items should be returned in the same manner received (e.g., furniture covered, cushions bagged).
• Wear & Tear: Minor scuffs or dye lot variances are inherent to rental items and do not warrant refunds.

6. Damage Waiver Fee

The Damage Waiver Fee covers rental items for minor damages caused by normal wear and tear usage during your event. Examples include minor stained or ripped fabrics or lightly scratched surfaces. The Damage Waiver Fee is non-refundable, taxable, and cannot be waived. This waiver does not cover gross negligence, theft, or mysterious disappearance.

7. Limitation of Liability & Indemnity

• Risk: Customer uses Goods at their own risk. Yellow Event Rentals is not liable for any injury, property damage, or lost profits arising from the use of the Goods.
• Indemnity: Customer agrees to defend and hold Yellow Event Rentals harmless from any third-party claims or legal fees arising from the Customer's event or use of the Goods.

8. Force Majeure

Yellow Event Rentals shall not be liable for delays or failures to perform caused by "Acts of God," strikes, government action, or other conditions beyond its reasonable control. In such cases, Yellow Event Rentals may cancel the contract without penalty.

9. Governing Law

This agreement is governed by the laws of the State of Maryland. Any disputes shall be litigated in Frederick County.
